Harvey Weinstein Won’t Face NY Rape Retrial, But DA Hints At Long Prison Stretch

Harvey Weinstein won’t face a fourth New York City trial on rape charges, but the much accused producer isn’t getting out of prison anytime soon, says the Manhattan District Attorney.

“Today, following discussions with Jessica Mann, who does not wish to testify again, and in accordance with our survivor-centered approach to prosecutions, we informed the court that we will not retry the remaining count of Rape in the Third Degree, D.A. Alvin Bragg announced early Thursday in a not unexpected shift in his office’s #MeToo strategy. “In consideration of Ms. Mann’s stance, and in recognition of Mr. Weinstein’s class B felony conviction for violently sexually assaulting Miriam Haley, we will not pursue a fourth trial and therefore moved to dismiss the remaining count.”

Already convicted by a Big Apple jury in 2020 on since overturned sex crimes, and remaining behind bars due to his 2022 L.A. sex crimes guilty verdict, the perpetually and publicly ailing 74-year-old Weinstein’s third New York rape trial ended in mid-May with a deadlocked jury.

That impasse saw MY Judge Curtis Farber declare a mistrial.

With the Pulp Fiction producer continuing to declare his innocence of the dozens and dozens of claims against him from A-lister actresses to Production Assistants and more, Bragg’s team at the time said: “We will consider our next steps in consultation with Ms. Mann, and in consideration of Harvey Weinstein’s pending sentencing following last year’s trial conviction for forcibly sexually assaulting Miriam Haley.”

That legal ship sailed today.

Noting “we believe Ms. Mann’s account and her credibility as a witness,” as well as praising her “honesty and her tremendous bravery,” Bragg’s office added: “We also shared our recommendation to the court that Mr. Weinstein be sentenced to 20 years in prison, which would account for the significant harms his actions have caused Ms. Haley.”

Already appealing his West Coast conviction, Weinstein’s side took today’s events as a rare win.

“Harvey is relieved by today’s outcome,” a rep for Weinstein told Deadline Thursday.

“We believe this is the result that should have been reached from the outset, had the grand jury been presented with the full scope of the emails, text messages, and other private communications,” they went on to say.

Looking for another Hail Mary in terms of the time their client spends in an upstate prison, Weinstein’s defense team added: “We will be submitting our sentencing materials in the coming weeks. As we argued following the original trial, we believe the prior sentence imposed by Judge Burke was excessive, and we intend to challenge the prosecution’s sentencing recommendations. Harvey has been a model inmate for nearly seven years, and we believe that record, along with the other relevant factors, should be given significant weight at sentencing.”
